TestimonialManager

Terms of Service

These terms govern your use of testimonialmanager.com and the TestimonialManager service. By creating an account or subscribing, you agree to them on behalf of yourself and the business you represent.

Who provides the service

The service is provided by the administrator of the testimonialmanager.com service, reachable at [email protected]. In these terms "we" and "us" mean the administrator, and "you" means the business that holds the account and every person it invites to it.

Your account

You must be at least 18 years old and able to act for your business. Keep your sign in details secure and tell us promptly if you believe someone else has accessed your account. You are responsible for what happens in your account, including actions by team members you invite.

Subscriptions and automatic renewal

TestimonialManager is sold only as a subscription. The plans are Starter, Growth, Scale and Enterprise, each with monthly or yearly billing. Yearly billing is selected by default at checkout and costs half of the monthly price per month, billed once a year in advance. Current prices and plan contents are on testimonial software pricing.

Your subscription renews automatically at the end of each billing period for another period of the same length, at the price in effect at that time, until you cancel it. You can cancel at any time under Billing in your account settings. Cancelling stops future renewals, and you keep access until the end of the period you already paid for.

A move to a higher plan or from monthly to yearly billing takes effect once the difference is paid, and that difference is charged immediately. A move to a lower plan takes effect from the next billing period.

There is no free plan. The interactive demo on the homepage works without an account and without a card.

If we change prices, we tell you by email before the change applies to your next renewal.

Usage limits

Each plan includes limits per billing period, such as brands or locations, automatic email requests, SMS requests, video testimonials, stored testimonials, AI highlights and transcripts, widgets, imported Google review locations and team seats. The limits are listed on the pricing page.

Limits count usage within the billing period. Deleting, hiding or archiving a testimonial, a request or a transcript does not give back quota already used. Quota resets at the start of the next billing period. When you reach a limit, the related action pauses until the next period or until you move to a higher plan.

Acceptable use

You agree to use TestimonialManager honestly and lawfully. In particular, you must not:

  • publish fake testimonials or reviews, including ones written by you, your staff or an AI tool and presented as coming from customers,
  • change a testimonial so that it says something the customer did not say or mean,
  • offer customers compensation or any other incentive conditioned on a positive or negative review or testimonial,
  • send the Google review link or other review requests only to customers you expect to be satisfied, or otherwise practice review gating,
  • hide negative reviews for their content while presenting what you show as all or most of your reviews,
  • present testimonials from employees, relatives or paid partners without disclosing that relationship,
  • send requests to people who have not agreed to receive messages from you, or ignore opt out requests,
  • upload content that is unlawful, infringing, hateful, sexually explicit or that contains other people's data without a right to use it,
  • request testimonials from children,
  • try to break, overload, scrape or reverse engineer the service, or access accounts that are not yours.

You must comply with the rules of the Federal Trade Commission on consumer reviews and testimonials and on endorsements, with Google's policies for reviews, and with the privacy, marketing and messaging laws that apply to you and your customers. General guidance is in our article on testimonial consent rules.

Collecting valid consent from your customers before you publish their words, name, photo or video is your responsibility. TestimonialManager gives you the tools to do it, including the consent wording on request pages, consent records with timestamps and a withdraw link, described on testimonial consent form. You decide what to ask for and what to publish.

We may suspend or remove content or accounts that break this section.

Your content

You keep ownership of everything you and your customers submit to the service: testimonials, videos, photos, tags, brand assets and settings. You give us a limited license to store, process, transcribe, display and deliver that content only as needed to provide the service to you, including showing approved testimonials in your widgets and walls.

You confirm that you have the rights and consents needed for the content you upload or publish. When a customer withdraws consent through the service, the related testimonial stops being shown in your widgets, and you remain responsible for removing it from anywhere else you copied it.

We own the TestimonialManager software, design and brand. These terms do not give you any rights to them beyond using the service.

AI output

AI highlights and transcripts are suggestions. They can contain mistakes, so review them before you publish. The original testimonial is kept unchanged, and nothing is published or edited based on an AI suggestion without your approval. You are responsible for what you choose to publish. As between you and us, AI output created from your content belongs to you.

Availability and changes to the service

We work to keep TestimonialManager running at all times, but it may occasionally be interrupted for maintenance or by events outside our control. Enterprise plans include a 99.9 percent availability commitment described in their plan terms. We may improve or change features over time. If we remove a feature that is a core part of your plan, we tell you in advance.

Payments

Prices are shown in US dollars and do not include taxes, which are added where required. Payments are taken in advance for each billing period through our payment processor. Payments are final, with the limited exceptions set out in our refund policy. If a payment fails, we retry it and may pause the account until the amount due is paid.

Termination

You can cancel your subscription at any time, and you can close your account by writing to [email protected]. We may suspend or end your account if you break these terms, fail to pay, or use the service in a way that harms others or puts the service at risk. Where it is reasonable, we warn you first and give you a chance to fix the problem. After an account is closed, your content can be exported for 30 days, and is then deleted as described in our privacy policy.

Disclaimers and limitation of liability

Apart from the commitments stated in these terms, the service is provided as is. To the extent the law allows, we are not liable for indirect, incidental or consequential losses, such as lost profits, lost revenue or lost data, and our total liability for any claim is limited to the amount you paid us for the service in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.

You agree to cover our reasonable costs from claims by third parties that arise from content you publish or from your breach of these terms, including claims by your customers about testimonials or messages you sent.

Governing law and disputes

These terms are governed by the laws that apply at the place where the service is administered, without regard to conflict of law rules, and disputes are handled by the competent courts there. If you are a consumer, you keep the protection of the mandatory laws of the country where you live. Before starting any formal dispute, please write to us so we can try to resolve it.

Changes to these terms

We may update these terms. The date at the top shows the latest version. If a change is significant, we notify account holders by email before it takes effect. Continuing to use the service after that date means you accept the updated terms.
